Applicants present in the UK as Tier 2 (Minister of Religion) migrants are usually able to extend their leave to remain up to a maximum period of 6 years. Tier 2 Religious Category is a visa for religious workers who have been offered employment from a religious organization in the United Kingdom. This visa allows mainly pastoral workers to stay legally in the UK and can be applied regardless of religion. The migrant does not necessarily need to be a qualified minister as missionaries and members of religious orders who are also able to benefit from the category.
Who can apply?
A religious visa is for religious ministers, missionaries, and religious orders. Religious workers must have been stayed in the UK to undertake mainly pastoral / preaching work, although the individual can also undertake some non-pastoral work. Religious activities include, but are not limited to, preaching and pastoral activities, leading worship, leading at marriages and funerals and offering counselling and welfare support to members of the organization.
What are the eligible elements?
Applicants must obtain a certificate of sponsorship (CoS) necessary for visa extension application from the religious organisation to which they belong. The sponsor must state the religious activities and salaries that the individual must perform during their stay in the UK. If the religious organisation is changed for an extension, the organisation should have sponsorship. If necessary, the sponsor must advertise for 28 days to prove that there is no appropriate person in the UK who can take the role.
It is important to note that the CoS should not be assigned until a resident labour market test has been completed, unless an exemption applies. Conducting a resident labour market test will involve advertising the role to the local labour market for a period of 28 days in order to demonstrate that there are no suitable settled workers available to take the role. Religious organisations are, however, frequently able to benefit from an exemption to the test.
Required documents
You must meet the financial and English requirements and documentation to identify the applicant. Individuals must submit CoS issued by a sponsor organisation to the UKVI, and if the CoS is issued by the same sponsor organisation, they must submit future employment plans as well as evidence of their previous salary and activities. If the individual change the sponsor to another organisation, the applicant might need to submit documents related to the previous experience/relevant training.
Settlement
This visa will allow religious workers with dependant family members apply permanent residency. Religious workers should have stayed in the UK for five years under the same visa category and should not be absent for more than 180 days a year for missionary work or other purposes. In addition, evidence of religious work within the stay should be submitted, and there should be a sponsor for applicants to continue their religious work in the future.
